These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Town of Hilliard.

REQUEST FOR RELEASE OF FUNDS

On or about February 8, 2020, the Town of Hilliard will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to make the following improvements: 

Activities:

Service Area #1  Georgia Street/West 2nd Avenue Water Line Replacement Service Area:

03J  Water Line Replacement Activity  

The activity to be carried out in Service Area #1 is to replace approximately 6,200 linear feet of existing potable water lines with new six-inch (6) PVC water lines, including fire hydrants and shut-off valves.  The scope of work to be carried out in Service Area #1 is as follows:

The replacement of the existing water line along Georgia Street between West 1st Avenue on the south and West 10th Avenue on the north, a distance of approximately 3,000 linear feet;

The replacement of the existing water line along West 2nd Avenue between Georgia Street on the west and Wisconsin Street on the east, a distance of approximately 3,200 linear feet;

All of the water lines being replaced in Service Area #1 are interconnected.

Service Area #1 is bound on the north by the intersection of Georgia Street and West 10th Avenue, on the south by the rear property line of the property located on the south side of West 2nd Avenue, on the east by the east side of the intersection of West 2nd Avenue and Wisconsin Street and on the west by the rear property line of the homes located on the west side of Georgia Street.

Service Area #2 Oxford Street Lift Station Service Area:

03J  Sewer Line Replacement  The activity to be carried out in Service Area #2 is to install an emergency electrical generator at the Oxford Street lift station located on the west side of Oxford Street approximately four hundred feet (400) south of west 5th Avenue.

Service Area #2 is bound on the north by the rear property lines of the properties located on the north side Webb Street, on the south by Bay Road, on the east by the CSX Railroad right-of-way, and on the west by the rear property lines of the properties located on the west side of Georgia Street.

A portion of the activities in Service Area #2 may be carried out within a floodplain and/or wetland.  Approximately .10 acre of land located within a floodplain and/or wetland may be included in the construction area.

A total of .10 acre of the work to be carried out in the primary activities included in this project may be carried out within a floodplain and/or wetland.

A small amount of impervious areas will be created in the Service Area included in this project.  In the case where new impervious surfaces are being created, storm drainage improvements will be included in the design and construction of the project to offset the impact of the additional impervious surfaces being created.

Failure to provide these improvements would result in the Town of Hilliard not being able to carry out the activities in the project.

FINDING OF NO 

SIGNIFICANT IMPACT

The Town of Hilliard has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Town of Hilliard Town Hall located at 15859 West CR 108, Hilliard, FL 32046 and may be examined or copied weekdays 8:30 A.M. to 5:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Lisa Purvis, Town Clerk, Town of Hilliard, P. O. Box 249, Hilliard, FL  32046.  All comments must be received by February 7, 2020.  Comments will be considered prior to the Town of Hilliard requesting a release of funds.  Comments should specify which notice they are addressing.

RELEASE OF FUNDS

The Town of Hilliard certifies to the Florida Department of Economic Opportunity and HUD that Floyd Vanzant in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The States approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Hilliard to use the CDBG funds.

OBJECTIONS TO RELEASE 

OF FUNDS

DEO will accept objections to its release of funds and the Town of Hilliard certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:  (a) the certification was not executed by the Certifying Officer of the Town of Hilliard; (b) the Town of Hilliard has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508.  Potential objectors should contact the Town of Hilliard to verify the actual last day of the objection period.
