Town of Callahan Referendums

On November 3rd  the Citizens of Callahan will have the opportunity to choose the future governing of the Town by voting “yes” or “no” on two referendum questions.

Referendum 1: Should the Charter of the Town of Callahan be amended to make the Mayor an office held by a member of the Town Council who is chosen by the Town Council, with the chief administrative duties that the Mayor used to perform being transferred to a Town Manager employed by the Town, along with the former Mayor’s veto power over ordinances being eliminated, with all changes happening when the current Mayor’s term ends?

Referendum 2: Should the Charter of the Town of Callahan be amended to make the Town Clerk an employee of the Town instead of an elected official, with the change happening when the current clerk’s term ends?

Referendum 1 would have the Town Council select one of the Council members to be a ceremonial Mayor. The duties of the Town’s chief administrative officer, that the Mayor, currently performs will be performed by a Town Manager. A majority vote of the Council will be needed to hire or fire a Town Manager.

Implications of a yes vote:

The Town Manager would be directly responsible to the Council.  The Council could remove the Manager at any time. An elected Mayor has a term of four years and is extremely hard to remove. The Mayor is not directly responsible to any other elected officials. The Town Manager would not have the residency requirement that the Mayor has so the pool of qualified persons is greatly increased.

Implications of a no vote:

The Citizens get to pick the Town’s chief administrator. The Mayor is not a fulltime position and less expensive.

Referendum 2 would have the Town Clerk also become an employee hired and fired by the Council.  The implications for and against are virtually the same as those for referendum 1.

Callahan’s future is very uncertain with the growth of the Town and County affecting what Callahan will be in the future. The Citizens will have the opportunity to decide how they want their officials to be chosen.

Plaintiff B Y FRANKLIN PROPERTIES, INC. (hereinafter, Franklin Properties), by and through its undersigned counsel, hereby sues JOHN NETTLES, JR., to quiet title, as well as any other unknown heirs and parties who are sued as JOHN DOES, and as grounds therefore alleges: 

1. This Court has jurisdiction pursuant to Florida Statute §§ 26.012(2)(g) and 86.011. 

2. Venue is proper because the real property subject to this action is located in Nassau County, Florida.

3. The actions in this Complaint pertain to and regard rights to real property located at 27195 New Front Street, Hilliard, FL 32046, more particularly described in Exhibit A (hereinafter, the Property). 

4. Franklin Properties has owned the Property in fee simple since November 28, 2017 pursuant to a Tax Deed, attached hereto as Exhibit B and located at OR Book 2159, Page 1556 of the Public Records of Nassau County, Florida (also, the Tax Deed). 

5. More specifically, however, Franklin Properties deraigns title as follows. 

6. Gerald J. Guynn conveyed the Property John M. Nettles and Linda A. Nettles by two warranty deeds dated June 24, 1994. John M. Nettles and Linda A. Nettles are the parents of JOHN NETTLES, JR.

7. The first such deed conveyed three platted lots and was recorded in Book 709, Page 925 of the Public Records of Nassau County, Florida. It is attached as Exhibit C. The second such deed conveyed one platted lot and was recorded in Book 709, Page 924 of the Public Records of Nassau County, Florida. It is attached as Exhibit D. 

8. Together, the real property conveyed by the deeds in Exhibit C and Exhibit D comprise the real property described and conveyed by Tax Deed to Franklin Properties in Exhibit B.

9. Taxes were not paid for 2010. Thereafter, tax certificates were sold and the holder of the tax certificates applied for a tax deed to be issued by the Nassau County Clerk of Court. The Clerk of Court duly advertised the application for the tax deed and otherwise duly complied with the statutes concerning the issuance of a tax deed. At the sale conducted by the Clerk, Franklin Properties was the highest and best bidder and the Clerk duly issued the Tax Deed attached as Exhibit B. 

10. Immediately on the recording of the Tax Deed to Franklin Properties, Franklin Properties entered into possession of the Property and has held possession of the Property under a claim of title exclusive of any other right and founded on the Tax Deed and have paid all of the taxes accruing on the land subsequent to the issuance of the Tax Deed.  

11. The issuance of the Tax Deed does not create marketable title in Franklin Properties so it is unable to convey, mortgage, or otherwise deal with the Property based on marketable title unless the NETTLES claim as the remaining heir to the owner prior to issuance of the Tax Deed is extinguished by this action. 

10. NETTLES is, upon information and belief, the only heir of John M. Nettles, Sr., and Linda A. Nettles. However, in order to properly quiet title, a diligent search must be performed to see if there are any other heirs. If there are none, Franklin Properties shall inform the Court and/or provide evidence of same.  

WHEREFORE, Franklin Properties demands judgment against NETTLES quieting title for the Property in the name of Franklin Properties.

4. The Franklin's have owned the Property in fee simple since November 13, 2018 pursuant to a Tax Deed, attached hereto as Exhibit B and located at OR Book 2236, Page 1119 of the Public Records of Nassau County, Florida (also, the "Tax Deed"). 

5. More specifically, however, the Franklin's deraign title as follows. 

6. Louise L. Hutchins conveyed the Property to JAMES F. HARTLEY, JR. by warranty deed dated June 4, 1997 and recorded in Book 796, Pages 899 and 900 of the Public Records of Nassau County, such deed being attached as Exhibit C. 

7. Taxes were not paid for 2016. Thereafter, tax certificates were sold and the holder of the tax certificates applied for a tax deed to be issued by the Nassau County Clerk of Court. The Clerk of Court duly advertised the application for the tax deed and otherwise duly complied with the statutes concerning the issuance of a tax deed. At the sale conducted by the Clerk, the Franklin's were the highest and best bidders and the Clerk duly issued the Tax Deed attached as Exhibit B. 

8. Immediately on the recording of the Tax Deed to the Franklin's, the Franklin's entered into possession of the Property and have held possession of the Property under a claim of title exclusive of any other right and founded on the Tax Deed and have paid all of the taxes accruing on the land subsequent to the issuance of the Tax Deed.

Are you planning ahead in case of an emergency?
Supervisors of Elections are in regular communications with the Department of State planning ahead for elections in case of emergencies such as hurricanes, power outages, pandemics, a shortage of Election Workers and other emergencies that may arise during an election.  Polling places may be combined which could cause long lines during Early Voting or on Election Day especially as we follow CDC guidelines involving social distancing. Voting by Mail is easy, convenient, safe and there are no lines. You can request your ballot be mailed and track it to ensure it has been received and will be counted. Notice is given that pursuant to a Summary Final Judgment of Foreclosure entered on August 5, 2020, in the above styled civil action of the Circuit Court, in and for Nassau, Florida, in which CALVIN MILES, JR., RHONDA MILES, STATE FARM FIRE AND CASUALTY COMPANY, A SUBROGEE OF BLANCA FOIL AND MIDLAND FUNDING, LLC,  ASSIGNEE OF WEBBANK FINGERHUT, are the Defendants, and BELLS RIVER ESTATES HOMEOWNERS ASSOCIATION, INC., is the Plaintiff, I will sell to the highest bidder for cash at 11:30 a.m. on October 1, 2020, on Nassau County’s Public Auction website: www.nassauclerk.realforeclose.com in accordance with Chapter 45, Florida Statutes, the following described real property set forth in the Summary Final Judgment of Foreclosure:

NOTICE OF PROPOSED TAX INCREASE

 

The Town of Hilliard has tentatively adopted a measure to increase its property tax levy.

Last year's property tax levy:

A. Initially proposed tax levy $   215,567

B. Less tax reductions due to

Value Adjustment Board and other

assessment changes $   85

C. Actual property tax levy $   215,652

This year's proposed tax levy $   267,353

All concerned citizens are invited to attend a public hearing on the tax increase to be held on September 21, 2020 at 7:00 p.m. in the Council Chambers located inside Town Hall, at 15859 West CR 108 Hilliard, Florida 32046

A FINAL DECISION on the proposed tax increase and the budget will be made at this hearing.
