PUBLIC HEARING NOTICE
The Hilliard Town Council will hold a Public Hearing on May 15, 2025, at 7:00 p.m., in the Council Chambers in the Hilliard Town Hall, located at 15859 West County Road 108, Hilliard, Florida, to hear input regarding Ordinance No. 2025-06. All interested parties may appear at the meeting and be heard with respect to the proposed Ordinance No. 2025-06.
Action on the matter may be taken following the closing of the Public Hearing at the Hilliard Town Councils regular meeting. AN ORDINANCE APPROVING RESOLUTION 2024-21 CONCERNING PROJECT NO. 45030, LOAN AGREEMENT, PLEDGED REVENUES, AND DESIGNATION OF AN AUTHORIZED REPRESENTATIVE.
PURSUANT TO THE REQUIREMENTS OF F.S. 286.0105, the following notification is given: If a person decides to appeal any decision made by the Council with respect to any matter considered at such meeting, he or she may need to ensure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based.

MANAGEMENT DISTRICT INTENDED DECISION(S)
The District intends to grant permit(s) for the consumptive use permit application(s)
described below at the District's Governing Board meeting on May 13, 2025: Clay County Utility Authority, 3176 Old Jennings Rd, Middleburg, FL 32068-3907 Consumptive Use Permit #416-52. The District proposes to authorize the use of 19.0 million gallons per day (mgd) of groundwater from the Upper and Lower Floridan aquifers for public supply use through 2030. If a special condition is met, the permit is extended through 2045 and the allocation increased to 22.7 mgd. The withdrawals used by this project will consist of Groundwater from FAS - Upper & Lower Floridan Aquifer via 1proposed well and 3 active wells in Clay County, located in Sections 20, 21 and 38,Township 5 South, Range 25 East. This site is known as Lake Asbury-Mid-Clay. The withdrawals used by this project will consist of Groundwater from FAS - Upper & Lower Floridan Aquifer via 5 active wells in Clay County, located in Section 37, Township 4 South, Range 26 East; Section 29, Township 5 South, Range 26 East. This site is known as Pace/Fleming Grid. The withdrawals used by this project will consist of Groundwater from FAS - Upper & Lower Floridan Aquifer via 1 proposed well and 2 active wells in Clay County. This site is known as Governors Park DRI. The withdrawals used by this project will consist of Groundwater from FAS - Upper Floridan Aquifer via 4 active wells;

The withdrawals used by this project will consist of Groundwater from FAS - Upper & Lower Floridan Aquifer via 1 proposed well and 5 active wells in Clay County, located in Section 4, Township 4 South, Range 25 East. located in Section 13, Township 5 South, Range 24 East. This site is known as Ravines.

A person whose substantial interests are or may be affected has the right to request an
administrative hearing by filing a written petition with the District. Pursuant to Chapter 28-106 and Rule 40C-1.1007, Florida Administrative Code (F.A.C.), the petition must be filed (received) either by delivery at the office of the District Clerk at District Headquarters, P. O. Box 1429,Palatka Florida 32178-1429 (4049 Reid St., Palatka, FL 32177) or by e-mail with the District Clerk at Clerk@sjrwmd.com, within twenty-one (21) days of newspaper publication of the notice
of intended District decision (for those persons to whom the District does not mail or email actual notice). A petition for an administrative hearing is deemed filed upon receipt of the complete petition by the District Clerk at the District Headquarters in Palatka, Florida during the District's regular business hours. The District's regular business hours are 8 a.m. 5 p.m., excluding weekends and District holidays. Petitions received by the District Clerk after the District's regular business hours shall be deemed filed as of 8 a.m. on the next regular District business day. A petition must comply with Sections 120.54(5)(b)4. and 120.569(2)(c), Florida Statutes (F.S.), and Chapter 28-106, F.A.C. The District's acceptance of petitions filed by e-mail is subject to certain conditions set forth in the District's Statement of Agency Organization and Operation (issued pursuant to Rule 28-101.001, F.A.C.), which is available for viewing at www.sjrwmd.com. The District will not accept a petition sent by facsimile (fax). Mediation may be available if you meet the conditions stated in the full Notice of Rights (see last paragraph).
The right to an administrative hearing and the relevant procedures to be followed are governed by Chapter 120, F.S., Chapter 28-106, F.A.C., and Rule 40C-1.1007, F.A.C. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means the District's final action may be different from the position taken by it in this notice. Failure to file a petition for an administrative hearing within the requisite time
frame shall constitute a waiver of the right to an administrative hearing. (Rule 28-
106.111, F.A.C.).
